NRI tax in India: the essentials
As an NRI, India taxes only your Indian income: rent from property in India, interest on NRO accounts, capital gains on Indian property, shares and mutual funds, and salary for work done in India. Your salary and investments abroad are outside Indian tax while you remain a non-resident.
Three things catch most NRIs out:
- Residential status changes with your days in India. Long visits, or Indian income above ₹15 lakh, can make you resident or RNOR. Check your status.
- TDS is deducted at high rates. Banks deduct 31.2% on NRO interest, tenants should deduct 31.2% on rent, and buyers deduct up to 14.95% of the full sale price of property. Your real tax is often far lower.
- Refunds and treaty benefits need action. A Tax Residency Certificate and Form 10F cut TDS on interest, a lower TDS certificate (Form 128) cuts TDS on a property sale, and filing a return gets excess TDS back.
What's new for 2026-27
- The Income-tax Act, 2025 took effect on 1 April 2026. "Previous year" and "assessment year" are replaced by a single tax year.
- Non-resident TDS moved from section 195 to section 393(2). Lower-TDS certificates moved from Form 13 to Form 128. Forms 15CA/15CB are now Forms 145/146.
- New-regime slabs are unchanged: nil up to ₹4 lakh, rising to 30% above ₹24 lakh.
